"AntiTerror": Beschwerde gegen FR-.-. --.- -.-. --.- -.-. --.- -.-. --.- -.-. --.- -.-. --.- Bekämpfung des Terrorismus in FR erlassenen Maßnahmen hat IRIS France Beschwerde bei der EU.Kommission erhoben. -.-. --.- -.-. --.- -.-. --.- -.-. --.- -.-. --.- -.-. --.- Meryem Marzouki As you may already know, France has adopted on October 31st "anti- terrorist" provisions in a law promulgated on November 15th, 2001. One of these provisions allows for systematic data retention, during up to one year. These data are referred to as "technical data involved in a communication". The type of data, as well as the actual duration of their retention by ISPs, should be defined by a decree, which has not yet been published. Although there have been strong opposition to these provisions in France, the law passed. IRIS has campaigned at the national level against this law with many actions http://www.iris.sgdg.org/actions/loi-sec After all the possibilities were tried at the national level, IRIS has decided to lodge a complaint with the European Commission against France, about this law, arguing that its provision on data retention is incompatible with both 95/46/CE and 97/66/CE Directives, as well as with the principles of Community law. The complaint has been lodged by IRIS on December 21st, and has been formally received (considered as admissible) by the EC on January 2002. The EC is examining the complaint and may (or may not) decide to take further actions, based on the results of its examination and the EC priorities (!). EC actions can go as further as to refer the case to the Court of Justice of the European Communities. Following is IRIS press release published yesterday (in French), giving more details on IRIS action. -.-. --.- -.-. --.- -.-. --.- -.-. --.- -.-. --.- -.-. --.- LSQ : IRIS porte plainte contre la France Communiqué de presse d'IRIS - 23 janvier 2002 L'association IRIS (Imaginons un réseau Internet solidaire) a déposé plainte contre la France auprès de la Commission européenne, pour non respect du droit communautaire. Cette plainte concerne la loi n°2001-1062 du 15 novembre 2001 sur la sécurité quotidienne (LSQ), visant particulièrement son article 29 (conservation des données techniques relatives à une communication, pendant une période pouvant s'étendre jusqu'à un an). Déposée par IRIS le 21 décembre 2001, la plainte a été jugée recevable par la Commission européenne en janvier 2002. Elle est actuellement examinée par la Commission, qui jugera de l'opportunité de saisir ultérieurement la Cour de justice des Communautés européennes. L'association rappelle que la France a déjà été condamnée à deux reprises par la Cour de justice des Communautés européennes, sur plainte de la Commission, pour manquement à son obligation de transposition des Directives 95/46/CE (arrêt du 14 février 2001) et 97/66/CE (arrêt du 18 janvier 2001). Aujourd'hui, la France manque une fois de plus à ses obligations en adoptant une mesure législative contraire à des dispositions contenues dans ces deux Directives, ainsi qu'à des principes du droit communautaire. La LSQ, dont la constitutionnalité demeure fortement douteuse, n'a pu être adoptée puis promulguée que par la connivence entre des représentants politiques de la majorité et de l'opposition, jusqu'aux plus hauts niveaux de l'État français. En portant sur le terrain du droit communautaire son combat mené au niveau national contre cette loi, IRIS entend utiliser l'ensemble des moyens démocratiques pour continuer de défendre les libertés et les droits fondamentaux contre les dérives sécuritaires.
